TERMS AND CONDITIONS

Booking Conditions

All bookings are subject to availability and payment confirmation. In order to confirm a booking, the guest must make the corresponding payment in accordance with the conditions applicable to each accommodation.

The booking rates, security deposit, cleaning fee, and any other charges are those published at any given time on the page of each accommodation.

A security deposit is required for all accommodations to cover any damage caused to the property and/or the condominium. The security deposit amount will be pre-authorised at check-in, where check-in is carried out in person, or up to 48 hours before the start of the booking, online, where express check-in is used. No amount will actually be charged to the guest, as this is merely a pre-authorisation that will block access to those funds until it is released.

If no damage to the property is identified during the stay, the security deposit will be released after check-out, to the same credit card, within a maximum of 7 days after departure.

If the property is not left in the same condition, the security deposit amount will be retained until the damaged items have been paid for.

The booking may be cancelled if the security deposit pre-authorisation cannot be completed, and it is therefore important that the guest ensures that their credit card is valid and has sufficient available funds. If it is not possible to pre-authorise the deposit, the guest will be notified by email or SMS and will have 12 hours to try to use another payment method.

All prices include VAT at the legal rate in force.

Payment Options

Bookings may be paid by American Express, Visa, or MasterCard credit card.

Guests are also subject to the specific rules made available for each accommodation.

Pre-check-in

After the booking has been completed, the lead guest will receive an email and/or SMS from The Magnólia Properties confirming the booking, together with important information about the accommodation and any available additional services, such as transfer services or extra cleaning services.

Guests will be invited to complete an Accommodation Bulletin, which is of the utmost importance for the preparation of the stay.

The Accommodation Bulletin will request, in particular, the arrival time, the total number of guests staying at the property — so that we may provide the appropriate quantity of bed linen and bath towels — as well as the mandatory information required for immigration and border control purposes.

Guests must indicate the exact number of people in the Accommodation Bulletin. The number of guests stated in the booking may not exceed the number of guests actually present at the accommodation.

If the number of guests exceeds the permitted limit, The Magnólia Properties reserves the right to require the guests to leave the accommodation, without any compensation or refund of the amounts paid.

The Magnólia Properties accepts no liability for the incorrect or incomplete completion of the Accommodation Bulletin.

Any attempt to alter and/or tamper with the original information will invalidate the Accommodation Bulletin and may lead to the cancellation of the booking.

Cancellation Policy

Once the booking has been confirmed, the following charges shall apply in the event of cancellation:

a) The guest shall pay 50% of the total booking amount in the event of cancellation up to 30 days before check-in.
b) The guest shall pay 100% of the total booking amount in the event of cancellation less than 30 days before the check-in date.

In the event of overbooking, meaning simultaneous bookings for the same accommodation, the guest expressly acknowledges and accepts that The Magnólia Properties may relocate the booking to accommodation of the same category, always ensuring that the quality of the accommodation provided is not inferior to that of the accommodation originally booked by the guest, at no additional cost to the guest and without any entitlement to compensation from The Magnólia Properties on that basis.

Stay Conditions

The lead guest must be at least 18 years old and must remain at the booked accommodation throughout the stay. Guests under the age of 18 may only stay when accompanied by an adult who is the lead guest.

The lead guest must provide a valid address, telephone contact number, and email address.

Pets of any breed, size, or age are not allowed in The Magnólia Properties accommodations. The Magnólia Properties reserves the right to require guests to leave the accommodation, without any compensation or refund of the amounts paid, if any animal is found inside the property.

Smoking is not permitted inside the accommodation.

Pursuant to article 45(1)(a) of the Convention Implementing the Schengen Agreement, the accommodation of foreign nationals must be reported to the immigration and border authorities, foreign nationals being understood as all persons who do not hold Portuguese nationality.

For the purposes of the preceding paragraph, all guests of foreign nationality must provide all identification information no later than the date of check-in through the Accommodation Bulletin.

Guests must report to The Magnólia Properties any damage to the accommodation, its contents, equipment, or accessories occurring during the stay, even if they consider it to be normal wear and tear or not attributable to them. Failure to do so may result in them being held liable for such damage.

Additional Services

The Magnólia Properties provides guests with various additional services, such as private transfers, cleaning and laundry services, cots, and tickets for various tourist attractions.

All additional services are provided upon request and are subject to availability confirmation.

The Magnólia Properties shall not be liable for any services provided by external suppliers.

Check-in and Check-out

At check-in, identification documents for the person responsible for the booking, as well as all foreign guests, will be requested in order to confirm the information provided.

Unless otherwise agreed, the accommodation may be occupied on the check-in date between 4:00 p.m. and 8:00 p.m.

In the case of late check-in — from 8:00 p.m. onwards — an express check-in service may be made available, and the guest must confirm this possibility in advance with The Magnólia Properties. The express check-in service depends on the guests having fully completed the Accommodation Bulletin in advance.

For late check-ins where it is not possible to provide the express check-in service, a fixed fee of €30 will be charged, payable at check-in.

Check-out must be completed by 11:00 a.m., and all guests must leave the accommodation by that time. Guests are requested to inform us of their intended check-out time so that a member of The Magnólia Properties team may be present.

If it is not possible for a member of The Magnólia Properties to be present at check-out, the guest may leave the keys on the main table inside the accommodation and close the door. The guest must not leave the keys in the door lock.

If the guest refuses to leave, The Magnólia Properties reserves the right to enter the accommodation, remove the guest’s belongings, change the locks, and take any other measures deemed necessary. The guest shall be responsible for the costs of any such actions.

Any changes to check-in and check-out dates and times must be confirmed by The Magnólia Properties. In the event of delays, without prior notice and without confirmation from The Magnólia Properties, the amount of the security deposit will be charged, together with an amount equivalent to one night’s rate.

At check-in, The Magnólia Properties provides only one set of keys, and guests must take care not to lose it or leave it inside the apartment. All keys must be returned at check-out.

Additional charges will apply in the event of lost keys or door opening assistance. The fees are as follows:

Loss of keys (price per key) – €30
Emergency call-out (between 9:00 a.m. and 6:00 p.m.) – €10
Emergency call-out (between 6:00 p.m. and 9:00 a.m.) – €25

If it is necessary to use a locksmith service, the guest shall be responsible for the full amount charged by the service provider.

The amount charged by the service provider will depend on the complexity, materials, time spent, and other variables.

The Magnólia Properties shall not be responsible for any items left in the apartment after the guest’s departure. Any belongings found may be returned upon request, and the guest shall be fully responsible for all costs associated with the return process.

Cleaning, Bed Linen and Towels

The accommodation will be cleaned before the guests’ arrival. The Magnólia Properties’ basic service includes one set of towels, bed linen, and some toiletries for each booking.

Additional cleaning services and products, including changes of bed linen and towels, are available for an additional fee.

Guests must keep the accommodation as tidy and clean as possible and leave it at check-out in the best possible state of cleanliness so that The Magnólia Properties may welcome the next guest.

Guests must not leave rubbish inside the accommodation, beside its door, or outside the building door, where applicable, and must use the street waste containers intended for that purpose.

Equipment, Furniture and Items in the Accommodation

If any equipment is not working, or if guests have any questions regarding how to use any equipment in the accommodation, they must contact the responsible host from The Magnólia Properties.

No alterations may be made to the accommodation or its contents.

All items in the accommodation belong to the owner and must not be moved or removed from the property during the stay.

Maintenance and Special Requests

Any issues inside the accommodation, such as electrical problems, equipment breakdowns, or water leaks, must be reported immediately to The Magnólia Properties by email or telephone. Depending on the issue, the respective resolution may take up to 72 hours or longer, where dependent on third-party services.

While always respecting guests’ privacy, The Magnólia Properties reserves the right to access the accommodation at any time, if necessary, for inspections, repairs, and emergency situations.

Extra beds and cots may be requested in advance but are subject to availability at the relevant time.

Noise, Illegal Activities and Safety

Under the law, the night-time quiet period runs from 10:00 p.m. to 8:00 a.m., and guests must therefore keep noise to a minimum.

Guests must not disturb neighbours, namely when opening or closing the door of the accommodation or the door of the building in which it is located, where applicable.

Bookings for illegal or immoral activities are not accepted.

The guest whose name appears on the booking confirmation email shall be responsible for the behaviour of the entire group and undertakes to prevent any illegal activity.

Guests are not authorised to invade the owner’s privacy or to publish any content that allows third parties to identify the address of the property or the identity of the owner, even if that information is already in the public domain.

Guests are solely responsible for their own safety during their stay with The Magnólia Properties. They must comply with any instructions or explanations given by The Magnólia Properties at check-in.

If, during the stay, a guest becomes aware of any situation that they believe poses a risk to health or safety, they must inform The Magnólia Properties immediately.

When leaving the accommodation, guests must ensure that gas appliances are turned off, windows are closed, and air conditioning, central heating, and lights are switched off.

Liability

The services of The Magnólia Properties are legally limited to the accommodation and the relationship with guests during their stay. The Magnólia Properties shall not be liable for any matters outside the boundaries of the accommodation, such as the cleaning and maintenance of the building, outside noise, building works, neighbours, or any other matter not directly related to the accommodation itself.

The photographs and descriptions of the accommodations are produced by The Magnólia Properties. Minor changes to the accommodation compared to the photographs on the website may occur, without affecting its general condition or amenities.

The Magnólia Properties will not compensate guests, refund amounts, or transfer guests to another accommodation based on the appearance of the property or its surroundings. It is the guests’ responsibility to ensure, before booking, that the selected area or neighbourhood is to their liking.

The Magnólia Properties shall not be liable for any damage caused, directly or indirectly, that may occur during the guests’ stay at the accommodation, such as personal injury, robbery, theft, or criminal behaviour, losses resulting from fire or misconduct, among others. The same applies to any failure in the supply of gas, electricity, water, telephone, or internet services.

Any robbery, theft, or criminal behaviour must be reported immediately by guests to The Magnólia Properties, as well as to the competent police or judicial authorities.

The Magnólia Properties shall not be liable for any delays, accidents, losses, or changes in schedules or prices related to the services of its suppliers. The Magnólia Properties shall also not be liable for errors and/or omissions, false statements made by third parties, disputes between the guest and third parties, or the content of external links, except for the website through which the booking was made.

If guests fail to comply with these terms and conditions, or in the event of inappropriate behaviour on their part, The Magnólia Properties reserves the right to require them to leave the accommodation, without any compensation or refund of the amounts paid.

Applicable Law and Force Majeure

This agreement is entered into between the guests and The Magnólia Properties, duly authorised to arrange the rental of the accommodation. This agreement grants guests permission to occupy the accommodation for the agreed period and under the agreed terms.

Guests are not tenants of the accommodation and do not hold exclusive possession of it.

In the rare event that a booked accommodation becomes unavailable due to damage caused by circumstances not attributable to The Magnólia Properties, such as water or gas leaks, The Magnólia Properties shall not be liable for the inconvenience caused. However, it will take all necessary measures to transfer the guest to accommodation with similar characteristics.

If the guests do not accept the change, the full amount paid will be refunded, excluding the costs relating to the days on which the apartment was used by the guest, where applicable. Neither the owner nor The Magnólia Properties shall be liable to the guests for any additional amount related to the cancellation of the booking.

The Magnólia Properties shall not be liable for any theft of objects left in the accommodation.

Amendments and Governing Law

The Magnólia Properties reserves the right to update its terms and conditions at any time, whenever necessary. It is the responsibility of the parties using The Magnólia Properties’ services to review these terms and conditions in the event of any amendment before making a booking.

By agreeing to use The Magnólia Properties’ services, the guest is deemed to accept any amendments, and all parties shall comply with them.

These terms and conditions do not affect the guests’ statutory rights.

These terms and conditions are governed by Portuguese law. The Portuguese courts shall have exclusive jurisdiction in the event of any legal action relating to any accommodation booking made with The Magnólia Properties.
