The protection of your personal data is a priority for The Magnólia Properties.
Below, we explain who we are, the purposes for which we may use your personal data, how we process it, with whom we share it, how long we retain it, and how you may contact us and exercise your rights.
Who we are?
Your data will be processed by The Magnólia Properties, Rentals & Property Management, Unip. Lda., registered under number 514181753, hereinafter referred to as The Magnólia Properties.
The Magnólia Properties is the controller of your personal data for the General Data Protection Regulation, hereinafter referred to as the GDPR.
Why do we process your information?
Your personal data may be collected and processed by The Magnólia Properties for the following purposes:
a) Compliance with legal obligations to which The Magnólia Properties is subject, namely communications to the immigration and border authorities and invoicing obligations.
b) Performance of the temporary tourist accommodation agreement or the local accommodation management agreement entered into with The Magnólia Properties, namely for payment transactions, check-in and check-out management, guest management, collection of security deposits, provision of stay-related ancillary services such as cleaning, transfers, breakfast or shopping services, management of contractual obligations, or pre-contractual steps.
c) Communications by mobile phone and email, including information and commercial communications, digital platforms, within the scope of The Magnólia Properties’ marketing strategies, as well as contractual and commercial communications, and responses to requests for information.
d) Protection of assets or property held by The Magnólia Properties, as well as for statistical analysis purposes.
Failure to provide personal data for the purposes set out in paragraphs a) and b) will place The Magnólia Properties in breach of legal obligations and may consequently lead to termination of the temporary tourist accommodation agreement or the local accommodation management agreement entered into, without entitlement to any compensation, as well as the impossibility of providing services by The Magnólia Properties for reasons not attributable to it.
What type of personal data do we collect?
In the course of its business activity, The Magnólia Properties will collect and process the personal data necessary for the provision of the contracted services, responses to requests for information, or pre-contractual management, namely identification data, contact details, and bank or payment card details.
On what basis do we process your information?
The processing of your personal data will be carried out on the basis of the performance of the temporary tourist accommodation agreement, the local accommodation management agreement, and compliance with legal obligations imposed on The Magnólia Properties, in particular by the legislation relating to the entry, stay, and departure of foreign nationals from national territory and by tax legislation, pursuant to article 6(1)(b) and (c) of the GDPR.
In addition, personal data collected for the purposes set out in paragraph c) above are based on the consent you have given to The Magnólia Properties for the respective processing, pursuant to article 6(1)(a) of the GDPR.
For the purposes set out in paragraph d) above, The Magnólia Properties will process personal data on the basis of its legitimate interest, pursuant to article 6(1)(f) of the GDPR.
How long do we keep your information?
Without prejudice to any legal or regulatory provisions or court decision to the contrary, the personal data collected will be retained only for the minimum period necessary for the purposes that justified their collection or subsequent processing.
With whom may we share your personal data?
The Magnólia Properties may need to share some of your personal data with other recipients. These recipients include:
a) Organisations and/or companies affiliated with The Magnólia Properties, provided that they comply with an equivalent personal data protection policy.
b) Public authorities to which The Magnólia Properties is legally required to provide information, namely the immigration and border authorities and the DGCI – Directorate-General of Taxes.
c) Subcontractors providing certain services related to your personal data under outsourcing arrangements and solely for the purpose of providing technical assistance to The Magnólia Properties, including, in particular, website hosting providers, email marketing service providers, cleaning companies, law firms, accounting firms, and insurers.
d) Competent authorities to which The Magnólia Properties is legally required to disclose information in the context of legal proceedings or for the detection of technical and/or security issues, such as judicial entities or competent supervisory authorities.
Are my data transferred to countries outside the European Union?
Your personal data collected by The Magnólia Properties will not be transferred to any entity established outside the territory of the European Union.
Exceptionally, and subject to certain conditions, The Magnólia Properties may transfer your personal data to countries outside the European Union in compliance with the applicable legislation, namely for the purposes of data hosting or storage, outsourced technical processing, backups and recovery of hosted data, or service development.
The Magnólia Properties ensures that it will not transfer your personal data to countries that do not guarantee an adequate level of protection under the GDPR.
What are my rights?
At any time, under the GDPR, you may request access to your personal data, as well as its rectification or erasure, restriction of processing, the right to object, and the right to data portability.
If the requests submitted are manifestly unfounded or excessive, in particular because of their repetitive character, The Magnólia Properties may charge a reasonable fee, taking into account the administrative costs of providing the information or communication or taking the requested action, or may refuse to act on the request.
In the case of personal data whose processing by The Magnólia Properties is based on your consent, you have the right to withdraw that consent, without affecting the lawfulness of the processing carried out on the basis of the consent previously given, nor the subsequent processing of the same data on another legal basis, such as contract performance or compliance with a legal obligation to which The Magnólia Properties is subject.
You also have the right to lodge a complaint with the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados).
Security and confidentiality
We are committed to keeping your data secure and use appropriate security measures to ensure that your personal data is protected and to prevent access to it by unauthorised persons.
However, the transmission of data over the internet is not completely secure and we cannot guarantee absolutely the security of information transmitted through our website.
We also respect the confidentiality of your information. For this reason, we do not sell, distribute, or otherwise make your information commercially available to third parties.
